NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that a public hearing will be held before the Planning Commission of the City of Moorpark, California, on Tuesday, December 19, 2023, at 7:00 p.m., at the Moorpark City Hall, located at 799 Moorpark Avenue, Moorpark, California, 93021, to consider the proposal described below.

NOTICE IS FURTHER GIVEN that the Community Development Director has determined that Zoning Ordinance Amendment No. 2023-03 is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15060(c)(2) and 15061(b)(3) of the State CEQA Guidelines because the proposed action would not result in a direct or reasonably foreseeable indirect physical change of the environment and CEQA applies only to projects which have the potential for causing a significant effect on the environment.  Therefore, the proposed action is exempt from CEQA and no further environmental review is necessary.

Entitlements: Zoning Ordinance Amendment No. 2023-03

Applicant: City of Moorpark

Proposal: Consider adopting a resolution recommending the City Council make a determination of exemption pursuant to CEQA and adopt an ordinance approving Zoning Ordinance Amendment No. 2023-03 to comply with Business and Professions Code Section 26320 et seq (Senate Bill 1186 (2022)), including adding Chapter 8.65 (Commercial Cannabis Activity Prohibited), modifying Chapter 17.08 (Definitions), Table 17.20.050(D), Table 17.20.060(A), and 17.20.070(A) and (D) of the Moorpark Municipal Code to clarify the prohibition of commercial cannabis activity throughout the city, except to allow licensed nonstorefront retail (delivery only) medicinal cannabis businesses as a conditionally permitted use within the M-1 zone, subject to specific location criteria.

Environmental Review:  Pursuant to Sections 15060(c)(2) and 15061(c)(3) Zoning Ordinance Amendment No. 2023-03 is exempt from environmental review because the proposed action would not result in a direct or reasonably foreseeable indirect physical change to the environment and CEQA applies only to projects which have the potential for causing a significant effect on the environment.  Therefore, no further environmental analysis is required pursuant to CEQA.

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that a public hearing will be held before the Planning Commission of the City of Moorpark, California, on Tuesday, December 19, 2023, at 7:00 p.m., at the Moorpark City Hall, located at 799 Moorpark Avenue, Moorpark, California, 93021, to consider the application described below. 

NOTICE IS FURTHER GIVEN that pursuant to California State law, the City Council adopted a Mitigated Negative Declaration (MND) on July 18, 2007, that analyzed the environmental impacts associated with the development of the 200 unit residential multi-family project.  The MND determined that there are no significant impacts with the inclusion of specific mitigation measures identified in the MND Mitigation Monitoring and Reporting Program.  The proposed amendments to the Development Agreement do not present any new or additional environmental impacts.  Therefore, the project remains consistent with the previously-adopted MND and no further environmental documentation is required.
